Terms of Service

The short version. Fitineary is a tracker, not a doctor. It gives you estimates, not measurements. Joining the early access list costs nothing and commits you to nothing — you can leave whenever you like. When the app launches it will be paid, and we will tell you the price before you are ever charged.

1. Who you are dealing with

Fitineary is operated by 7th Pillar Infotech ("we", "us"), registered at 1st Floor, Sree Vilas, Darshan Nagar Rd, near DLF, Kakkanad, Kochi, Kerala 682037. "You" means you, whether you are on the early access list, using the app, or using it as a coach.

By joining the early access list or using Fitineary, you agree to these terms. If you do not agree with them, please do not use Fitineary.

2. What these terms cover

These terms cover the Fitineary website at fitineary.app, the early access list, and the Fitineary app once it is released. Our Privacy Policy explains what we do with your personal data and forms part of these terms.

3. Fitineary is not medical advice

Fitineary gives you estimates, not medical measurements. It is not a medical device. It does not diagnose, treat, cure or prevent any condition, and nothing in it is medical, nutritional or clinical advice.

Calorie and macronutrient targets are calculated from standard published formulas using the details you enter. They are approximations for a general population, not a prescription for you. Food figures are estimates and portions vary enormously. Calorie burn from exercise is estimated from intensity and body weight, and can be substantially wrong for any individual.

Talk to a doctor before starting any new diet or training programme, particularly if you have a medical condition, are pregnant or breastfeeding, are taking medication, or have any history of disordered eating. If you feel unwell while exercising, stop and seek medical help.

You are responsible for what you choose to eat and how you choose to train. You use Fitineary at your own risk.

4. Early access

Joining the early access list means:

We are not promising a launch date, and we are not promising to launch at all. Fitineary is in development. Features described on our website are what we intend to build and may change, be delayed, or be dropped. Anything shown under a heading such as "what we're building next" does not exist yet. App screens shown on our website contain example data for illustration and are not real people's records.

5. Pricing and the promises we have made

Fitineary will be a paid subscription for individual users once released. We have not set the final price. We will tell you the price before you are ever asked to pay it, and you will always see it and confirm it before any charge is made. Subscriptions bought through the App Store or Google Play are billed by Apple or Google under their terms, and refunds are handled by them.

Founder pricing for early access members

If you joined the early access list before launch, you will be offered "founder pricing" — a launch price held for your first twelve months from the day you subscribe, even if the standard price rises in that period. To be clear about the limits: it applies to the account using the email address you joined with, it is not transferable, it does not survive a lapsed subscription, and it applies for twelve months rather than indefinitely.

The coach offer

Coaches in the first cohort described on our coach page are offered the coach tools at no charge on the account they signed up with. Because that offer has been described as "free for life", here is what it does and does not mean:

Clients pay their own subscription. That is charged directly to them and never passes through their coach.

6. Accounts

When accounts exist, you are responsible for keeping your login details secure and for activity on your account. Tell us promptly if you think someone else has access. You must be 18 or over to use Fitineary. One person, one account.

Fitineary provides tools. It does not provide coaching and does not vet, employ, endorse or supervise coaches. Any coaching relationship is between you and your coach: they set their own fees and terms, and we are not a party to it and not responsible for the advice they give.

A coach can see your logs only after you connect them, and only from that point on. You can disconnect at any time. Coaches must have a lawful basis for handling their clients' data and must not add anyone to their roster without that person's own agreement.

9. Who owns what

Your data is yours. Everything you log stays yours, and you can ask for a copy or for deletion at any time. You give us permission to store and process it so we can run the service and show it to a coach you have connected — nothing more.

Fitineary is ours. The name, logo, software, exercise library, content and design belong to 7th Pillar Infotech. You may use the service; you do not get ownership of it.

10. Availability and changes

We will try to keep Fitineary running and reliable, but we do not guarantee uninterrupted availability. We may change, suspend or withdraw features. If a change materially reduces what a paid subscription gives you, we will give you notice and, where appropriate, a pro-rata refund.

11. Ending it

You can stop using Fitineary at any time and delete your account from within the app. We may suspend or close an account that breaches section 7, or where we are required to by law. Where it is reasonable to do so we will warn you first and give you a chance to put it right, and we will give you a way to export your data before closing an account.

12. Liability

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Indian law — including your rights as a consumer under the Consumer Protection Act, 2019.

Subject to that: Fitineary is provided "as is". We are not liable for indirect or consequential loss, for loss of profit, or for any outcome of decisions you make about diet or training based on estimates the app produced. Our total liability to you in any twelve-month period is limited to the amount you paid us in that period.

13. Governing law

These terms are governed by the laws of India, and the courts of Cochin, Kerala have exclusive jurisdiction — except that if you are a consumer, this does not deprive you of the protection of your local law or your right to bring a claim where you live.

14. Changes to these terms

We may update these terms. The version and date at the top always tell you which version is current. If a change materially affects your rights we will email you before it takes effect. Continuing to use Fitineary after that means you accept the new terms; if you do not, you can close your account and we will refund any unused paid period.
